Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and DevelopPrecision ("we", "us", "our") regarding your use of the LifeByDesign website, web application, and related services (collectively, the "Service"). If you do not agree to these Terms, do not use the Service.

These Terms work alongside our Privacy Policy, which explains how we handle your personal information.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using LifeByDesign you confirm that you have the legal capacity to enter into this agreement and that the information you provide is accurate.

To use most features you must create an account. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us promptly at the contact details below if you suspect unauthorised access.

You may close your account at any time. We may need to retain certain information after closure as described in our Privacy Policy or as required by law.

"Your Content" means the goals, vision statements, journal entries, habits, health inputs, financial figures, and any other material you submit to the Service. As between you and us, you own Your Content.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, and process Your Content solely to operate, secure, and improve the Service for you. We do not sell Your Content and we do not use it to train third-party foundation models.

You are responsible for Your Content and must have the right to submit it. Do not submit content that is unlawful, infringing, or that contains the personal information of others without their permission.

You agree not to:

• use the Service to violate any law or the rights of others;
• upload malware or attempt to disrupt, probe, or reverse-engineer the Service;
• scrape, crawl, or harvest data from the Service without our written permission;
• circumvent rate limits, authentication, billing, or access controls;
• resell, sublicense, or commercially exploit the Service without our agreement;
• use the Service to generate, store, or distribute content that is harassing, defamatory, sexually explicit involving minors, or that incites violence.

The Service includes AI-assisted features (reflections, suggestions, summaries, planning prompts). AI output is generated probabilistically and may be inaccurate, incomplete, or unsuitable for your situation.

AI output is not professional advice. LifeByDesign is not a substitute for qualified medical, psychological, financial, legal, or other professional advice. Do not rely on AI output for decisions that require professional judgement. In emergencies, contact local emergency services.

You are responsible for reviewing AI output before acting on it and for any decisions you make based on it.

Parts of the Service may be offered free of charge during early access. Paid plans, when introduced, will be billed through a third-party payment processor (e.g. Stripe). Prices, billing intervals, and renewal terms will be disclosed at the point of purchase.

Unless required by applicable consumer-protection law, fees are non-refundable. You may cancel a recurring subscription at any time; cancellation takes effect at the end of the current billing period.

The Service relies on third-party providers, including Lovable Cloud (Supabase) for database, authentication, and storage; OpenAI / the Lovable AI Gateway for AI features; Stripe for payments; and PostHog for product analytics. Your use of those providers' features through the Service may also be subject to their terms.

We are not responsible for third-party websites, products, or services linked from the Service.

The Service, including its software, design, branding, and content created by us, is owned by DevelopPrecision or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose in accordance with these Terms.

Feedback you provide is given without expectation of compensation, and we may use it to improve the Service.

We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if continued provision creates risk to us, other users, or third parties. Where reasonably possible we will give you notice and an opportunity to remedy.

On termination, your right to use the Service ends. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnity, governing law) will survive.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

We do not warrant that the Service will be error-free, secure, or continuously available, or that AI output will be accurate or fit for your purposes.

Nothing in these Terms excludes or limits any rights you have under the South African Consumer Protection Act, 2008, or any other consumer-protection law that cannot lawfully be excluded.

To the maximum extent permitted by law, DevelopPrecision and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) ZAR 1,000.

You agree to indemnify and hold harmless DevelopPrecision against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service in breach of these Terms, your violation of any law, or your infringement of any third-party right.

These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict-of-laws rules. The courts of South Africa will have non-exclusive jurisdiction over any dispute arising out of or related to these Terms, except that we may bring proceedings to protect our intellectual property in any jurisdiction.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose laws grant you mandatory protections, those protections continue to apply notwithstanding this clause.

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
